WCVA Wales Trustee and Governance Conference 2007
The WCVA WTGC 07, held on I November last, was a great success and WCVA would like to express its thanks to all those who supported this inaugural event. Next year’s event will most likely be held in Swansea early November 2008. The conference presentations have now been uploaded onto the WCVA Trustees and Governance website.
WCVA Annual Conference & AGM 2007
The WCVA Annual Conference & AGM 2007 takes place on Thursday 29 November at Venue Cymru, Llandudno. This year’s conference theme, Brave new world, same as the old world?, looks at the actual impact major sector change such as Charity Commission regulatory reform, the Assembly’s Strategic Plan and public service delivery are having on the ground. Sector experts, including a key note address from Dame Suzy Leather, Chair of the Charity Commission, will consider these key policy issues in a mix of presentations and workshops. Tax-Effective Giving Workshops
WCVA and the Institute of Fundraising are running a series of one-day training workshops looking at tax effective giving. They will consider the forthcoming change in basic rate tax and what they will cost your organisation, and will identify new and innovative ways to increase your Gift Aid claims. Charity Commission updates public benefit guidance timetable
The Charity Commission (CC) has published a revised and updated timetable for the development of its public benefit advice and guidance for charities following the consultation earlier this year on draft guidance. The general public benefit guidance for all charities is slated to be published in January 2008, with 4 sub-sectoral consultations to follow shortly thereafter. Other key implementation dates are set out in the revised timetable.
New charity list
The CC has launched a web-based list of recently registered charities which will help umbrella, membership and support organisations introduce the help they can offer to new charities in a more targeted and timely way. The list allows anyone to view newly registered charities on a daily, weekly, monthly or quarterly basis. The charities are listed alphabetically and the postcode is that of the charity’s registered correspondent. Further information from the relevant Register entry can be obtained by clicking on the charity’s name.
Finding New Trustees
The CC has recently updated its publication, Finding new trustees - What charities need to know (CC30).
Charity Commission Register of Mergers
The Charities Act 2006 requires the CC to set up a Register of Mergers and this is due to come on-line later this month. In the interim, the CC has published guidance on its website about Mergers and Collaborative Working in advance of the Register going live. The Register will mean that, for charities that have merged, any future legacies in their name will be able to be applied to the successor charity direct once the merger has been registered with the Commission. This means that failed legacies will no longer require a scheme to apply the funds to the successor charity, nor will it be necessary to leave ‘shell’ charities on the Central Register of Charities to receive legacies. Please see the October editions of Trustee news, which provided related information on the ICSA guidance for charity mergers.
Governance standards
The Governance Hub has produced, Meeting the Standards, a guide to help trustees attain the competences set out in the Trustee and Management Committee National Occupational Standards. It provides useful advice on different aspects of the Standards alongside an extensive round-up of publications, websites and other resources available to help trustees put the Standards into practice.
Mentoring for chairs
The Governance Hub has also published, Mentoring for Chairs, based on a mentoring pilot programme. This guide will be of use to anyone interested in setting up or funding mentoring schemes for chairs and vice-chairs, and will also be of interest to those who have established their own informal mentoring relationships, or are intending to do so.
Monitoring and evaluation resources
A catalogue of monitoring and evaluation resources has been compiled by Charities Evaluation Services, detailing over 100 books, tools, discussion papers, web sites etc. CES has also published summary findings from a survey on monitoring and evaluation practice in the third sector.
Strategic analysis resources
NCVO's Third Sector Foresight project has launched a new site bringing together a variety of resources to help voluntary and community organisations create effective plans with strategic insight and planning tools.
Governance responsibilities for health and safety
Leading Health and Safety at Work is a new guide launched by the Health and Safety Commission and the Institute of Directors. The aim of these guidelines is to remind all directors, governors, trustees, officers and their equivalents in the private and third sector that they must take the lead on health and safety matters, regardless of the size of their organisation. Too often health and safety requirements are overlooked by business organisations who view compliance as a hindrance to productivity.
The guidance takes a common sense approach, offering straightforward practical advice relating to health and safety policy in the workplace. It sets out a four-step process to establish essential health and safety principles and also provides a summary of legal liabilities, a checklist of key questions for leaders and a list of resources and references for implementing the guidance in detail. With the Corporate Manslaughter Act coming into force next year and with it, the possibility of courts considering the ‘attitude’ of an organisation to health and safety and the extent to which it followed guidance, this publication makes essential reading.
Companies Act 2006 implementation
The Companies Act implementation timetable has been delayed and the commencement date for most of the provisions due to be commenced on 1 October 2008 will be put back to 1 October 2009. Those provisions due to be commenced in April 2008 will not be affected and will go ahead as planned. The Government will make a further Statement in December setting out the final commencement timetable.
Freedom of Information Act 2000 consultation
On the 25 October last the Ministry of Justice issued its consultation, Freedom of Information Act 2000: Designation of additional public authorities. The aim of the consultation document is to seek views as to whether the Government should look to use the powers under Section 5 of the Freedom of Information Act 2000 and extend the coverage of the Act and if so, which organisations it should consider. This has clear implications for third sector organisations that provide public services and WCVA will be issuing a response prior to the 1 February 08 closing date.
Sharing personal information
The Information Commissioner's Office has issued a Framework Code of Practice for Sharing Personal Information. The new document explains in plain English how public and private sector organisations that need to share people's personal information can set up their own arrangements to ensure that, where personal information is shared, good practice is adopted. The framework helps organisations decide when to share information, what information to share, highlights the consequences of sharing and deals with the issue of consent. The ICO will be able to endorse organisations' own codes of practice subject to the right to audit arrangements on the ground.
Work experience guide
The Workforce Hub has published, Bright Futures, Positive Influence: Creating a successful work experience placement in the third sector, a guide designed to help third sector organisations offer more and better student work experience placements.
Voluntary Sector Workforce Almana
The Workforce Hub has launched the first edition of the, UK Voluntary Sector Workforce Almanac 2007, providing information on the size and characteristics of the UK voluntary sector workforce (including its diversity). It also presents reliable and authoritative ten-year trend data (1996-2005) enabling an exploration of how the sector’s workforce has changed.
No fee for charity sales on eBay
As of 15 November charities have been able to sell items on eBay for free after the online auction site announced it would start to credit all admin fees back to charity sellers. The changes to its eBay for Charity fee donation policy mean that charities which have set up online shops on the site will now have both the 15p fee for listing an item, plus any final selling fees credited back to them.
For the last 12 months when charities made a sale on the site, they have been credited back their selling fees, which average around 10 per cent depending on the cost of the item, but still had to pay the flat rate 15p listing fee. The changes also mean the process will speed up, with charities receiving their credited fees a few weeks, rather than a few months after the online sale.
Grant bridging loans
Unity Trust Bank has launched a new short-term bridging loan for sector organisations that are waiting to receive grant funding. The bank said it recognized that many voluntary organisations relied on grant funding but often had no control over when the cheques arrived. Loans will generally be offered for a maximum of three months but could be extended in exceptional cases, and could also be cancelled if the grant was received earlier than expected.
Sources of financial help for individuals
A new charity, turn2us, has launched a "groundbreaking online service" which provides individuals with details of all of the benefits and grants available to them from both statutory and voluntary organisations.

The latest newsletter from the ICT Hub has a focus on wireless computing and communication, both within the office and around the country.
Tax allowances for 2008–09
The Treasury has published the 2008-09 rates and allowances for Income Tax, National Insurance Contributions, Working and Child Tax Credits, Child Benefit/Guardian’s Allowance and State Pension and Pension Credit. A full list of all the proposed increases for other benefits will be announced later this year by the Secretary of State for Work and Pensions.
Registered social landlords HMRC
Charities has introduced a new form, for completion by charitable Registered Social Landlords who want an opinion about whether certain transactions will be subject to corporation tax. Further information can be obtained from the Housing Corporation including Guidance on affordable home ownership and taxation liability.
Retirement and Age Discrimination
The European Court of Justice has handed down its opinion in the important case of Palacios v Cortefiel Servicios SA, holding that the EU Equal Treatment Framework Directive does not prohibit member states from introducing mandatory retirement ages. Whilst it held that a general mandatory retirement age did fall within the scope of what the Directive prohibited, it considered that a mandatory retirement age was justified, as it was a proportionate means of achieving the legitimate social aim of promoting employment opportunities and reducing unemployment.
TUPE
In Jackson v Computershare Investor Services the Court of Appeal has held, on unusual facts, that TUPE does not confer additional rights so as to improve an employee's situation. TUPE Reg 5(1) does not give a transferred employee access to benefits other than those to which the employee was entitled before the transfer of the undertaking. It safeguards existing rights. So for the question of enhanced severance pay TUPE could not be used to "miraculously transform" Mrs Jackson into someone who joined Computershare pre-2002 when, as a fact, she joined Computershare in 2004. The original tribunal was wrong and she was not entitled to the enhanced payment.
Maternity Pay Increases Delayed until April 2010
The Government still has a goal to extend Statutory Maternity Pay, Maternity Allowance and Statutory Adoption Pay from 39 weeks to 52 weeks, and to introduce Additional Paternity Leave and Pay by the end of this Parliament. However, a Notice issued last month states that the plans have been put back by a year, and the HMRC will now start planning implementation for babies due on or after April 2010.

DBERR has updated its excellent booklet, Individual rights and responsibilities of employees: a guide for employers and employees, to reflect October 2007 changes to employment regulations. The guide outlines employees' individual rights and responsibilities and the corresponding obligations on employers.

Mae’r Comisiwn Elusennau (CE) wedi cyhoeddi amserlen wedi’i diwygio a’i diweddaru ar gyfer datblygu ei gyngor a’i gyfarwyddyd ynghylch budd cyhoeddus i elusennau yn dilyn yr ymgynghoriad a gynhaliwyd yn gynharach eleni am gyfarwyddyd drafft. Bwriedir cyhoeddi’r cyfarwyddyd budd cyhoeddus cyffredinol ar gyfer pob elusen ym mis Ionawr 2008, gyda 4 ymgynghoriad is-sector yn dilyn yn fuan wedi hynny. Rhestr elusennau newydd
Mae’r CE wedi lansio rhestr o elusennau a gofrestrwyd yn ddiweddar ar y we a fydd yn helpu mudiadau ambarél, mudiadau aelodaeth a mudiadau cefnogaeth i gyflwyno’r cymorth y gallant ei gynnig i elusennau newydd mewn modd sydd wedi’i dargedu a’i amseru’n well. Mae’r rhestr yn galluogi unrhyw un i weld elusennau sydd newydd gael eu cofrestru bob dydd, bob wythnos, bob mis neu bob chwarter blwyddyn. Cofrestr Cyfuno’r Comisiwn Elusennol
Mae’n ofynnol dan Ddeddf Elusennau 2006 bod y CE yn sefydlu Cofrestr Cyfuno, a bydd y gofrestr ar gael ar-lein yn ddiweddarach yn ystod y mis hwn. Yn y cyfamser, mae’r CE wedi cyhoeddi cyfarwyddyd ar ei wefan am Gyfuno a Gweithio ar y Cyd cyn i’r Gofrestr ymddangos yno. Bydd y Gofrestr yn golygu, ar gyfer elusennau sydd wedi’u cyfuno, y bydd unrhyw gymynroddion yn eu henw yn y dyfodol yn gallu cael eu priodoli i’r elusen olynol wedi i’r cyfuniad gael ei gofrestru gyda’r Comisiwn. Golyga hyn na fydd angen cynllun ar gyfer cymynroddion a fethodd er mwyn priodoli’r cronfeydd i’r elusen olynol, nac angen gadael elusennau ‘cragen’ ar y Gofrestr Elusennau Ganolog er mwyn derbyn cymynroddion. Safonau llywodraethu
Mae’r Canolbwynt Llywodraethu wedi cynhyrchu Meeting the Standards, canllaw i helpu gwirfoddolwyr i sicrhau’r cymwyseddau a nodir yn Safonau Galwedigaethol Cenedlaethol y Pwyllgor Ymddiriedolwyr a Rheoli. Mae’n darparu cyngor defnyddiol am wahanol agweddau ar y Safonau, ynghyd â chrynodeb cynhwysfawr o gyhoeddiadau, gwefannau ac adnoddau eraill sydd ar gael i helpu ymddiriedolwyr i weithredu’r Safonau yn ymarferol.
Mentora ar gyfer cadeiryddion
Mae’r Canolbwynt Llywodraethu hefyd wedi cyhoeddi Mentoring for Chairs, sy’n seiliedig ar raglen fentora beilot. Bydd y canllaw hwn yn ddefnyddiol i unrhyw un â diddordeb mewn sefydlu neu ariannu cynlluniau mentora i gadeiryddion ac is-gadeiryddion, a bydd o ddiddordeb hefyd i’r rhai hynny sydd wedi sefydlu eu cysylltiadau mentora anffurfiol eu hunain, neu sy’n bwriadu gwneud hynny.
Adnoddau monitro a gwerthuso
Mae’r Gwasanaethau Gwerthuso Elusennau wedi llunio catalog o adnoddau monitro a gwerthuso, gan roi manylion dros 100 o lyfrau, pecynnau, papurau trafod, gwefannau, ayb. Mae’r Gwasanaeth Gwerthuso Elusennau hefyd wedi cyhoeddi crynodeb o'r canfyddiadau o arolwg o arferion monitro a gwerthuso yn y trydydd sector.
Adnoddau dadansoddi strategol
Mae prosiect Third Sector Foresight NCVO wedi lansio gwefan newydd sy’n dod ag amrywiaeth o adnoddau at ei gilydd i helpu mudiadau gwirfoddol a chymunedol i greu cynlluniau effeithiol gydag offer cynllunio a mewnwelediad strategol.
Cyfrifoldebau llywodraethu dros iechyd a diogelwch
Mae Leading Health and Safety at Work yn ganllaw newydd a lansiwyd gan y Comisiwn Iechyd a Diogelwch a’r Sefydliad Cyfarwyddwyr. Nod y canllawiau hyn yw atgoffa pob cyfarwyddwr, llywodraethwr, ymddiriedolwr, swyddog a’r bobl gyfatebol yn y sector preifat a’r trydydd sector bod rhaid iddynt oll arwain o ran materion sy’n ymwneud ag iechyd a diogelwch, waeth beth yw maint eu mudiad neu eu sefydliad. Yn rhy aml, aiff gofynion iechyd a diogelwch yn angof gan sefydliadau busnes, sy’n gweld cydymffurfio fel rhwystr i gynhyrchedd.
Mae’r cyfarwyddyd yn defnyddio synnwyr cyffredin, gan gynnig cyngor ymarferol syml ynglŷn â pholisïau iechyd a diogelwch yn y gweithle. Mae’n amlinellu proses pedwar cam i sefydlu egwyddorion iechyd a diogelwch hanfodol, ac mae hefyd yn darparu crynodeb o rwymedigaethau cyfreithiol, rhestr wirio o gwestiynau allweddol i arweinyddion a rhestr o adnoddau a chyfeiriadau ar gyfer gweithredu’r cyfarwyddyd yn fanwl. Gyda’r Ddeddf Dynladdiad Corfforaethol yn dod i rym y flwyddyn nesaf, gan gyflwyno’r posibilrwydd o lysoedd yn ystyried ‘agwedd’ sefydliad tuag at iechyd a’r diogelwch ac i ba raddau y dilynwyd cyfarwyddyd, bydd darllen y cyhoeddiad hwn yn hanfodol.
Gweithredu Deddf Cwmnïau 2006
Mae amserlen gweithredu’r Ddeddf Cwmnïau wedi’i gohirio, a chaiff dyddiadau cychwyn y rhan fwyaf o’r darpariaethau a oedd i fod i gychwyn ar 1 Hydref 2008 eu gohirio tan 1 Hydref 2009. Ni fydd effaith ar y darpariaethau hynny a oedd i fod i gychwyn ym mis Ebrill 2008, a byddant yn cychwyn yn unol â’r cynlluniau. Bydd y Llywodraeth yn gwneud Datganiad pellach ym mis Rhagfyr, gan amlinellu’r amserlen derfynol ar gyfer cychwyn.
Ymgynghoriad Deddf Rhyddid Gwybodaeth 2000
Ar 25 Hydref, cyhoeddodd y Weinyddiaeth Cyfiawnder ei hymgynghoriad, Deddf Rhyddid Gwybodaeth 2000: Dynodi awdurdodau cyhoeddus ychwanegol. Nod dogfen yr ymgynghoriad yw ceisio safbwyntiau am a ddylai’r Llywodraeth geisio defnyddio’r grymoedd dan Adran 5 Deddf Rhyddid Gwybodaeth 2000 ac ymestyn yr hyn a gynhwysir dan y Ddeddf, ac os felly, pa fudiadau y dylai eu hystyried. Mae gan hyn oblygiadau amlwg i fudiadau’r trydydd sector sy’n darparu gwasanaethau cyhoeddus, a bydd WCVA yn cyhoeddi ymateb cyn y dyddiad cau, sef 1 Chwefror 2008.
Rhannu gwybodaeth bersonol
Mae Swyddfa’r Comisiynydd Gwybodaeth wedi cyhoeddi Cod Ymarfer Fframwaith ar gyfer Rhannu Gwybodaeth Bersonol. Mae’r ddogfen newydd yn egluro, mewn Saesneg clir, sut y gall sefydliadau’r sector cyhoeddus a’r sector preifat, sydd angen rhannu gwybodaeth bersonol pobl, sefydlu eu trefniadau eu hunain i sicrhau y mabwysiadir arfer da wrth rannu gwybodaeth bersonol. Mae’r fframwaith yn helpu sefydliadau i benderfynu pryd i rannu gwybodaeth a pha wybodaeth i’w rhannu, yn rhoi sylw i ganlyniadau rhannu ac yn ymdrin â chydsyniad. Bydd y Swyddfa’n gallu cymeradwyo codau ymarfer sefydliadau unigol yn amodol ar yr hawl i archwilio trefniadau yn y lleoliad.
Canllaw profiad gwaith
Mae Canolbwynt y Gweithlu wedi cyhoeddi Dyfodol Disglair, Dylanwad Cadarnhaol: Creu lleoliad profiad gwaith llwyddiannus yn y trydydd sector, canllaw a luniwyd i helpu mudiadau’r trydydd sector i gynnig mwy o leoliadau profiad gwaith i fyfyrwyr, a rhai gwell.
Almanac Gweithlu’r Sector Gwirfoddol
Mae Canolbwynt y Gweithlu wedi lansio rhifyn cyntaf Almanac Gweithlu Sector Gwirfoddol y DU 2007, sy’n darparu gwybodaeth am faint a nodweddion gweithlu sector gwirfoddol y DU (gan gynnwys ei amrywiaeth). Mae hefyd yn cyflwyno data tuedd deng mlynedd (1996-2005) sy’n ddibynadwy ac yn awdurdodol, gan alluogi archwilio’r ffordd y mae gweithlu’r sector wedi newid.
Dim ffi am werthu elusennol ar eBay
Er 15 Tachwedd, mae elusennau wedi gallu gwerthu eitemau ar eBay am ddim ar ôl i’r safle arwerthu ar-lein gyhoeddi y byddai’n dechrau credydu’r holl ffioedd gweinyddol yn ôl i’r gwerthwyr elusennol. Mae’r newidiadau i’w bolisi rhoddi ffioedd eBay for Charity yn golygu y bydd elusennau sydd wedi sefydlu siopau ar-lein ar y safle’n derbyn y ffi 15c am restru eitem, ac unrhyw ffioedd gwerthu terfynol, yn ôl fel credyd.
Am y 12 mis diwethaf, pan fu elusennau’n gwerthu ar y safle, maent wedi cael eu ffioedd gwerthu’n ôl fel credyd, sydd tua 10 y cant ar gyfartaledd gan ddibynnu ar gost yr eitem, ond roedd rhaid iddynt dalu’r ffi rhestru 15c. Mae’r newidiadau hefyd yn golygu y bydd y broses yn gyflymach, gydag elusennau’n derbyn y ffioedd a gredydir iddynt rai wythnosau, yn hytrach na rhai misoedd, ar ôl y gwerthiant ar-lein.
Benthyciadau pontio grantiau
Mae Banc Unity Trust wedi lansio benthyciad pontio tymor byr newydd ar gyfer mudiadau sector sy’n aros i dderbyn cyllid grant. Dywedodd y banc ei fod yn cydnabod bod nifer o fudiadau gwirfoddol yn dibynnu ar gyllid grant, ond eu bod yn aml heb ddim rheolaeth dros ba bryd y byddai’r sieciau’n cyrraedd. Yn gyffredinol, cynigir benthyciadau am hyd at dri mis, ond gellid ymestyn hyn mewn achosion eithriadol, a gellid eu canslo hefyd pe câi’r grant ei dderbyn yn gynharach na’r disgwyl.
Ffynonellau cymorth ariannol ar gyfer unigolion
Mae elusen newydd, turn2us, wedi lansio ‘gwasanaeth ar-lein arloesol’ sy’n rhoi manylion yr holl fudd-daliadau a grantiau sydd ar gael i unigolion gan fudiadau statudol a gwirfoddol.

Lwfansau treth ar gyfer 2008-09
Mae’r Trysorlys wedi cyhoeddi cyfraddau a lwfansau 2008-09 ar gyfer Treth Incwm, Cyfraniadau Yswiriant Gwladol, Credyd Treth Gwaith a Chredyd Treth Plant, Budd-daliadau Plant/Lwfans Gwarcheidwad a Phensiwn y Wladwriaeth a Chredyd Pensiwn. Cyhoeddir rhestr lawn o’r holl gynnydd arfaethedig ar gyfer budd-daliadau eraill yn ddiweddarach eleni gan yr Ysgrifennydd Gwladol dros Waith a Phensiynau.
Landlordiaid cymdeithasol cofrestredig
Mae Elusennau Cyllid a Thollau EM wedi cyflwyno ffurflen newydd, i’w llenwi gan Landlordiaid Cymdeithasol Cofrestredig sydd eisiau barn am a fydd rhaid talu’r dreth gorfforaeth ar gyfer rhai trafodion penodol. Gellir cael mwy o wybodaeth gan y Gorfforaeth Tai, gan gynnwys Cyfarwyddyd am fod yn berchen cartref fforddiadwy a rhwymedigaeth treth.
Ymddeol a Gwahaniaethu ar sail Oedran
Mae Llys Cyfiawnder Ewrop wedi cyflwyno ei farn yn achos pwysig Palacios v Cortefiel Servicios SA, gan benderfynu nad yw Cyfarwyddeb Fframwaith Triniaeth Gyfartal yr UE yn atal aelod wladwriaethau rhag cyflwyno oedrannau ymddeol gorfodol. Er ei fod wedi derbyn bod oedran ymddeol gorfodol cyffredinol yn dod o fewn yr hyn yr oedd y Gyfarwyddeb yn ei wahardd, roedd yn ystyried bod modd cyfiawnhau oedran ymddeol gorfodol, gan ei fod yn ddull cymesur o gyflawni’r nod cymdeithasol cyfreithlon o hyrwyddo cyfleoedd am gyflogaeth a lleihau diweithdra.
TUPE
Yn achos Jackson v Computershare Investor Services, mae’r Llys Apêl wedi penderfynu, ar sail ffeithiau anarferol, nad yw TUPE yn rhoi hawliau ychwanegol er mwyn gwella sefyllfa gweithiwr. Nid yw Rheoliad 5(1) TUPE yn caniatáu i weithiwr a drosglwyddir gael budd-daliadau heblaw’r rhai hynny yr oedd gan y gweithiwr hawl iddynt cyn trosglwyddo’r ymgymeriad. Mae’n diogelu’r hawliau sy’n bodoli eisoes. Felly, yn achos tâl diswyddo uwch, ni ellid defnyddio TUPE i drosglwyddo Mrs Jackson ‘yn wyrthiol’ i fod yn rhywun a ymunodd â Computershare cyn 2002 pan, mewn gwirionedd, ymunodd â Computershare yn 2004. Roedd y tribiwnlys gwreiddiol yn anghywir ac nid oedd ganddi hawl i gael y tâl uwch.
Gohirio Cynnydd mewn Tâl Mamolaeth tan Ebrill 2010
Mae’r Llywodraeth dal â’r nod o gynyddu Tâl Mamolaeth Statudol, Lwfans Mamolaeth a Thâl Mabwysiadu Statudol o 39 wythnos i 52 wythnos, a chyflwyno Cyfnod a Thâl Tadolaeth Ychwanegol erbyn diwedd cyfnod y Senedd hon. Fodd bynnag, mae Hysbysiad a gyhoeddwyd y mis diwethaf yn datgan bod y cynlluniau wedi’u gohirio am flwyddyn, ac y bydd Cyllid a Thollau EM yn awr yn dechrau cynllunio i weithredu hyn ar gyfer babanod sydd i’w geni ym mis Ebrill 2010 neu wedi hynny.
