Nominate a trustee for national award

Nominations are being sought for an awards scheme that rewards and recognises the dedication of volunteers who have helped make the biggest difference in the communities in which they live. Wales Volunteer of the Year is an award scheme that has gone from strength to strength in recent years and culminates in an award ceremony in June during Volunteers’ Week. This year, a new category has been added specifically to recognise trustees and promote trusteeship. So if you know a trustee that deserves special recognition for their efforts, why not nominate them for the Wales Volunteer of the Year Award 2007? The deadline for receipt of nominations is 13 April 2007. This year, the awards are supported by Class Telecommunications. Class has worked with the sector since 1998 and is providing voluntary organisations with significant savings, excellent service and free advice on all aspects of telecoms.

Recruiting Trustees

People from all walks of life become trustees of voluntary organisations, and together they contribute huge amounts of time and energy to a wide variety of good causes. Becoming a trustee can also bring significant personal and career benefits to individuals. WCVA can assist with both advertising your vacancy and alerting individuals to opportunities. Running parallel to the Get on Board campaign in England, vacancies can be either advertised or sought via our Goodmoves website, Network Jobs publication and www.volunteering-wales.net.

Charities Act 2006 implementation

The first series of provisions of the Charities Act 2006 are due to come into force on 27 February 2007. The Charities Act 2006 (Commencement No.1, Transitional Provisions and Savings) Order 2007 has been published. It brings into force the first set of provisions of the Charities Act 2006. The main provisions that are being commenced now are:

  • Increases to the financial thresholds above which charities must have a professional audit
  • Measures to address concerns around the potential personal liability of charity trustees
  • Changes to the Charity Commission’s governance arrangements.

The Commencement Order also gives Ministers a power to vary the income threshold above which small charities are required to register with the Charity Commission (CC). The intention is for the income threshold to be raised from £1,000 to £5,000 along with the removal of the existing requirement for charities to register regardless of income if they hold permanent endowment or occupy land. This change is expected in April 2007. Further detail is available on the Cabinet Office website, and general reference material on the Act can be found on the CC website.

VAT cash accounting scheme extended

A special VAT scheme to help cash flow in small firms will be extended from 1 April 2007. The Cash Accounting Scheme allows eligible businesses to defer paying their VAT until they have received payment from their customers - as opposed to the usual practice of accounting for and paying VAT when they issue and receive invoices. This applies equally to charities and greatly helps with cash flow management. The relevant HMRC Notice 731 will have to be updated with new thresholds but explains the basic principles of the concession.

Charity tax scam

HMRC has warned of a scam that involves an email with a fake HMRC heading. The email asks charities to provide banking details so that a repayment can be issued. HMRC Charities will never contact a charity or Community Amateur Sports Club by email for this type of information, but you may be confused if you have recently submitted a repayment claim. This type of email scam is known as a ‘phishing’ exercise and it should always be ignored and deleted. If you have any concerns about anything received supposedly from HMRC Charities contact the helpline.

Mobile phones and driving

From 27 February 2007 drivers using hand-held mobile phones while driving will get three points on their licenses as well as an increased fine from £30 to £60. The Royal Society for the Prevention of Accidents says employers have a responsibility to protect their employees and other road users by having policies in place to ban the use of mobiles while driving for business. They emphasised that hands-free kits are not the answer because drivers are still significantly distracted.

CRB checks

The Criminal Records Bureau (CRB) has achieved self-funding status, resulting in fees for criminal record checks being frozen at last year’s levels. The freeze has been made possible thanks to technological advances, including the launch of an online tracking tool that enables customers to follow the progress of their CRB check. The disclosure fees for 2007/08 are £31.00 for a standard CRB check and £36.00 for an enhanced CRB check. A POVA First Check will cost £6 while volunteer checks will continue to be free. Charity Commission consultation on CRB checks

The CC has launched a 12week consultation on its approach to CRB checks for trustees of charities working with children or vulnerable adults. The consultation paper Criminal Records Bureau checks of trustees of charities explains the Commission’s policy on CRB checks, both for existing charities and those registering for the first time. It asks for charities’ and other interested parties’ views on the policy’s effectiveness and seeks input to inform the final policy which will be published later this year.

It is the responsibility of trustees to ensure that appropriate CRB checks are carried out. The Commission’s current interim policy asks to see CRB disclosures for trustees before registering charities working with vulnerable beneficiaries. Both WCVA and the Charity Law Association have raised issues about the legal principals underpinning this policy, and suitable responses will be submitted.

Guidance on ‘doorstep’ charity collections

The UK's three charity regulators have joined forces to stop British households being misled when responding to doorstep collections for 'charity'. While legitimate charities can collect cash or goods door-to-door, not all such collections are undertaken by charities, but some may be businesses who sell your donations for profit. OSCR, the CC and the Department for Social Development in Northern Ireland have today published Doorstep Collection - Making an Informed Choice, which gives householders key pointers to help them sort charity collections from commercial ones.

CC annual return consultation

The CC has announced a consultation about the new draft Annual Return form for 2007. A significant new area on returns is a requirement to report "serious incidents" that would result "in a significant loss of funds or a significant risk to a charity’s beneficiaries, resources or reputation." The guidance notes explain further that this would include a situation where there are serious allegations or suspicions, even if these have been dismissed or the matter has already been investigated by another authority such as the police. The key changes, with links to the specific Annual Returns for the four income-bands can be found here. The consultation runs until 19 March 2007.

Contract variations and TUPE transfers

In Power v Regent Security Services the EAT handed down an interesting decision on contractual variations following a TUPE transfer. The case was decided under TUPE 1981, but the principles remain relevant to the new TUPE 2006. It was held that the Daddy's Dance Hall case principle - namely that changes to contracts made as a result of TUPE transfers are void - does not apply to changes which are to the benefit of the employee. It is only changes to the detriment of the employee that are void. The core reasoning is at paragraphs 49-54.

Increase in annual leave entitlement

The DTI has announced an increase in minimum holiday entitlement under the Working Time Regulation 1998, from 20 days to 28 days per annum. Some employers currently include the eight bank holidays as part of workers' 20-day annual leave entitlement. This change effectively requires them to add the eight bank holidays to the 20-day annual leave entitlement. Statutory annual leave entitlement will be increased in two stages, rising from 20 to 24 days on 1 October 2007, and from 24 to 28 days on 1 October 2008. There is to be a second round of public consultation, closing on 13 April 2007, on the implementation of these changes and further information can be found here.

Working with cancer

Cancer is now deemed to be a disability under the DDA 1995. The CIPD, in association with Working with Cancer charity, has produced a superb booklet entitled Cancer and working: guidelines for employers, HR and line managers. It contains guidance on best practice for employers dealing with employees suffering from cancer, together with information on adjustments that can be made. This is a very worthwhile document for all employers, and for those litigating cases involving employees suffering from cancer.

Managing online risks

The ICT Hub features an article Limiting Your Risk Of Libel And Defamation. Protecting Your Users, written by charity specialist law firm Bates Wells & Braithwaite. It looks at the specific considerations and legal provisions that apply to the internet.

ICT collaborative working guides

Advances in ICT have offered opportunities for greater collaboration, linking multiple partners across large distances. However, many organisations using online collaboration may not realise the full potential of the ICT tools they use. The Information and Communication Technology (ICT) Hub and NCVO's Collaborative Working Unit have produced two free publications to help organisations work collaboratively to make the most of ICT:

  • ICT tools to support collaborative working

Charity Awards 2007

Entries are now being accepted for the Charity Awards 2007, the charity sector’s well-established celebration of management excellence. Organised by Plaza Publishing and sponsored by CAF, the Charity Awards are open to charities of all sizes from throughout the UK. Gweithredu Deddf Elusennau 2006

Bydd y gyfres gyntaf o ddarpariaethau Deddf Elusennau 2006 yn dod i rym ar 27 Chwefror 2007. Mae Gorchymyn Deddf Elusennau 2006 (Cychwyn Rhif 1, Darpariaethau Trosiannol ac Arbedion) 2007 eisoes wedi’i gyhoeddi. Yn ei sgil, daw'r gyfres gyntaf o ddarpariaethau Deddf Elusennau 2006 i rym. Y prif ddarpariaethau sy’n cael eu rhoi ar waith yn awr yw:

  • Cynyddu’r trothwyon ariannol sy’n pennu bod elusennau yn gorfod cael archwiliad proffesiynol os ydynt yn mynd y tu hwnt iddynt
  • Mesurau i fynd i’r afael â phryderon am atebolrwydd personol posib ymddiriedolwyr elusennau
  • Newidiadau i drefniadau llywodraethu’r Comisiwn Elusennau.

Mae’r Gorchymyn Cychwyn hefyd yn rhoi pwer i Weinidogion amrywio’r trothwy incwm sy’n pennu bod elusennau bach yn gorfod cofrestru gyda’r Comisiwn Elusennau os ydynt yn mynd y tu hwnt iddo. Y bwriad yw codi’r trothwy incwm o £1,000 i £5,000 yn ogystal â dileu’r gofyniad presennol bod elusennau’n gorfod cofrestru waeth faint o incwm a gânt os ydynt yn dal cronfa waddol barhaus neu dir. Ehangu’r cynllun cyfrifo arian TAW

Caiff cynllun TAW arbennig sy’n helpu llif arian mewn busnesau bach ei ehangu o 1 Ebrill 2007 ymlaen. Mae’r Cynllun Cyfrifo Arian yn rhoi caniatâd i fusnesau cymwys ohirio talu TAW hyd nes eu bod wedi derbyn y taliad gan eu cwsmeriaid - yn hytrach na’r drefn arferol o gyfrifo a thalu TAW wrth gyhoeddi a derbyn anfonebau. Mae’r cynllun hwn yn berthnasol i elusennau hefyd ac fe fydd o gymorth mawr wrth reoli llif arian. Bydd rhaid diweddaru’r Hysbysiad perthnasol (Hysbysiad 731 Cyllid a Thollau Ei Mawrhydi) gyda’r trothwyon newydd ond mae’n egluro egwyddorion sylfaenol y consesiwn.

Sgam treth elusennau

Mae Cyllid a Thollau Ei Mawrhydi wedi rhybuddio pobl am sgâm mewn perthynas â negeseuon e-bost ffug oddi wrth Cyllid a Thollau Ei Mawrhydi. Mae’r e-bost yn gofyn i elusennau ddarparu manylion eu cyfrif banc fel y gellir gwneud ad-daliad. Ni fydd Adran Elusennau - Cyllid a Thollau Ei Mawrhydi byth yn cysylltu ag elusen na Chlwb Chwaraeon Amatur Cymunedol drwy e-bost i ofyn am y math hwn o wybodaeth, ond mae’n ddigon posib y gallech gael eich camarwain os ydych wedi cyflwyno cais am ad-daliad yn ddiweddar. Yr enw ar y math hwn o dwyll yw ‘potsian’ (phishing) a dylech anwybyddu a dileu’r math hwn o e-bost bob tro. Os ydych chi’n poeni am unrhyw neges honedig o Adran Elusennau - Cyllid a Thollau Ei Mawrhydi, yna cysylltwch â’r llinell gymorth.

Ffonau symudol a gyrru

O 27 Chwefror 2007 ymlaen, bydd gyrwyr sy’n dal ffôn symudol yn un llaw ac yn gyrru gyda’r llall yn cael tri phwynt ar eu trwydded yn ogystal â dirwy o £60 (yn hytrach na £30 o’r blaen). Mae’r Gymdeithas Frenhinol er Atal Damweiniau yn dadlau bod gan gyflogwyr gyfrifoldeb i warchod eu gweithwyr a defnyddwyr ffyrdd eraill drwy sefydlu polisïau i wahardd gyrwyr rhag defnyddio ffonau symudol tra’n gyrru yn rhinwedd eu swydd. Maent yn pwysleisio nad offer ‘dim dwylo’ yw’r ateb chwaith oherwydd eu bod hwythau’n tynnu sylw gyrwyr hefyd.

Archwiliadau’r Swyddfa Cofnodion Troseddol

Mae’r Swyddfa Cofnodion Troseddol wedi cyrraedd statws hunan-gyllido, ac o ganlyniad, mae’r ffioedd ar gyfer archwiliadau wedi’u rhewi ar lefelau'r llynedd. Llwyddwyd i gadw’r ffioedd ar yr un lefel diolch i ddatblygiadau technolegol, gan gynnwys lansio gwasanaeth olrhain ar-lein sy’n galluogi cwsmeriaid i olrhain hynt eu harchwiliad. Y ffioedd ar gyfer 2007/08 yw £31.00 ar gyfer archwiliad Swyddfa Cofnodion Troseddol safonol a £36.00 ar gyfer archwiliad Swyddfa Cofnodion Troseddol manwl. Bydd Archwiliad Cyntaf i Amddiffyn Oedolion Diymgeledd (POVA) yn costio £6 tra bydd archwiliadau gwirfoddolwyr yn parhau i fod yn rhad ac am ddim. Ymgynghoriad y Comisiwn Elusennau ar archwiliadau’r Swyddfa Cofnodion Troseddol

Mae’r Comisiwn Elusennau wedi lansio ymgynghoriad 12 wythnos ar ei safbwynt ynghylch cynnal archwiliadau Swyddfa Cofnodion Troseddol ar ymddiriedolwyr elusennau sy’n gweithio gyda phlant neu oedolion diymgeledd. Mae’r papur ymgynghori Archwiliadau Swyddfa Cofnodion Troseddol ar gyfer ymddiriedolwyr elusennau yn egluro polisi’r Comisiwn ar archwiliadau’r Swyddfa Cofnodion Troseddol, mewn perthynas ag elusennau cyfredol ac ar gyfer y rheiny sy'n cofrestru am y tro cyntaf. Mae’n ceisio barn elusennau, a phawb sydd â diddordeb, ar effeithiolrwydd y polisi ac yn gofyn am fewnbwn i oleuo’r polisi terfynol, a gaiff ei gyhoeddi yn nes ymlaen eleni.

Cyfrifoldeb yr ymddiriedolwyr yw sicrhau bod yr archwiliadau Swyddfa Cofnodion Troseddol cywir yn cael eu cynnal. Mae polisi cyfredol dros-dro y Comisiwn yn gofyn i ymddiriedolwyr ddangos eu datgeliadau Swyddfa Cofnodion Troseddol cyn y cofrestrir elusennau i weithio gyda buddiolwyr diymgeledd. Yn hynny o beth, mae WCVA a’r Gymdeithas Cyfraith Elusennau, ill dau, wedi lleisio pryderon am yr egwyddorion cyfreithiol sy’n sail i’r polisi hwn, a byddwn yn cyflwyno sylwadau ar hyn.

Canllawiau ar gasglu arian i elusennau ar stepen drws

Mae’r tri rheoleiddiwr elusennau yn y DU wedi ymuno â’i gilydd i geisio atal pobl ym Mhrydain rhag cael eu camarwain gan gasgliadau i ‘elusen’ ar stepen eu drws. Er bod elusennau cyfreithlon yn gallu mynd o ddrws i ddrws i gasglu arian neu nwyddau, nid elusennau yw’r unig rai sy'n mynd o gwmpas, mae’n bosib mai busnesau yw rhai ohonynt sy’n gwerthu eich rhodd i elusen.

Heddiw, mae OSCR, y Comisiwn Elusennau, a’r Adran Datblygu Cymdeithasol yng Ngogledd Iwerddon wedi cyhoeddi Casgliadau Stepen Drws - Gwneud y Dewis Cywir, sy’n rhoi rhai pwyntiau allweddol i breswylwyr fel y gallant wahaniaethu rhwng casgliadau gan elusen a chasgliadau masnachol.

Ymgynghoriad y Comisiwn Elusennau ar y ffurflen datganiad blynyddol

Mae’r Comisiwn Elusennau wedi cyhoeddi ymgynghoriad ar ffurflen ddrafft newydd y Datganiad Blynyddol ar gyfer 2007. Adran arwyddocaol newydd ar y datganiad blynyddol yw’r gofyniad i gofnodi ‘digwyddiadau difrifol’ sy’n arwain at "golli cyfran sylweddol o gyllid neu beri risg sylweddol i fuddiolwyr, adnoddau neu enw da’r elusen." Aiff y nodiadau canllaw ymlaen i egluro y byddai hyn yn cynnwys sefyllfa lle gwneir honiadau difrifol neu fod yna ddrwgdybiaethau difrifol, hyd yn oed os yw’r rhain wedi’u gwrthod neu fod awdurdod arall, megis yr heddlu, eisoes wedi ymchwilio i’r mater. Gellir gweld y newidiadau allweddol, gyda dolenni i’r Datganiadau Blynyddol penodol ar gyfer y pedwar band incwm, yma. Daw’r ymgynghoriad i ben ar 19 Mawrth 2007.

Amrywiadau i gontract a throsglwyddiadau TUPE

Yn yr achos Power v Regent Security Services, daeth yr EAT i benderfyniad diddorol ar amrywiadau i gontract yn dilyn trosglwyddiad TUPE. Datryswyd yr achos dan TUPE 1981, ond mae’r egwyddorion yn dal i fod yn berthnasol i’r TUPE 2006 newydd. Penderfynwyd bod yr egwyddor yn achos Daddy's Dance Hall - sef bod newidiadau a wnaed i gontractau yn dilyn trosglwyddiadau TUPE yn annilys - yn amherthnasol i newidiadau sydd o fudd i’r gweithiwr. Dim ond newidiadau sy’n rhoi’r gweithiwr dan anfantais sy’n annilys. Gallwch ddarllen y rhesymeg sydd wrth wraidd y penderfyniad ym mharagraffau 49-54.

Hawl i gael mwy o wyliau blynyddol

Mae’r Adran Diwydiant a Masnach wedi cyhoeddi, dan Reoliadau Amser Gwaith 1998, bod gan weithwyr hawl i gael o leiaf 28 diwrnod y flwyddyn o wyliau blynyddol, sef cynnydd o’r 20 diwrnod presennol. Mae rhai cyflogwyr ar hyn o bryd yn cynnwys yr wyth gwyl banc yn yr 20 diwrnod o wyliau blynyddol i weithwyr. Ond, mae’r newid hwn yn mynnu bod rhaid iddynt adio’r wyth gwyl banc ar ben yr 20 diwrnod o wyliau blynyddol. Gweithredir y cynnydd hwn mewn hawl statudol i wyliau blynyddol mewn dau gam. Bydd yn codi o 20 i 24 ar 1 Hydref 2007, ac o 24 i 28 ar 1 Hydref 2008. Bwriedir cynnal ail rownd o ymgynghoriad cyhoeddus ar weithredu’r newidiadau hyn a fydd yn dod i ben ar 13 Ebrill 2007. Gweithio gyda chancr

Mae cancr erbyn hyn wedi’i ddosbarthu fel anabledd dan Ddeddf Gwahaniaethu ar Sail Anabledd 1995. Mae’r Sefydliad Siartredig Personél a Datblygu (CIPD), ar y cyd â’r elusen Working with Cancer, wedi cynhyrchu llyfryn gwych dan y teitl Cancer and working: guidelines for employers, HR and line managers. Ynddo, ceir canllawiau ar arfer da i gyflogwyr wrth ddelio gyda gweithwyr sy’n dioddef cancr, yn ogystal â gwybodaeth am rai addasiadau y gellir eu gwneud. Mae hon yn ddogfen werthfawr iawn i bob cyflogwr a bydd yn hynod ddefnyddiol mewn achosion ymgyfreitha sy’n ymwneud â gweithwyr sy'n dioddef cancr.

Gwobrau Elusennau 2007

Gwahoddir enwebiadau nawr ar gyfer Gwobrau Elusennau 2007, sef dathliad y sector elusennau, sydd wedi hen ennill ei blwyf, i wobrwyo rhagoriaeth ym maes rheoli. Trefnir y digwyddiad gan Plaza Publishing ac fe’i noddir gan CAF ac mae croeso i elusennau ledled y DU, o bob siâp, lliw a llun, gyflwyno eu henwebiadau ar gyfer y Gwobrau. Y dyddiad olaf ar gyfer derbyn enwebiadau yw 16 Mawrth ac fe gyhoeddir enwau’r enillwyr mewn seremoni wobrwyo a chinio ysblennydd yn Llundain ar ddydd Iau 21 Mehefin.
