WCVA Volunteers and the law conference

The WCVA Volunteers and the law conference will be held on Thursday 13 September 2007 at the Riverfront Arts Centre, Newport. It aims to help volunteer managers and trustees to gain a better understanding of law in relation to volunteers.

Mark Restall of Volunteering England (author of Volunteers and the Law) will introduce the theme, and a choice of workshops allows exploration in greater depth of topics such as volunteer rights, ‘duty of care’, trustees and criminal records. Specialist knowledge from organisations including the Charity Commission, Compass Insurance, the Criminal Records Unit and WCVA legal services will be available at an ‘information marketplace’, and there will be a chance to put your questions to a panel of experts during the afternoon. Trustee standards

What Management Committees Need to Know, is a guide that helps small voluntary organisations and community groups understand the Trustee and Management Committee National Occupational Standards, and provides an introduction to key issues related to the running of their organisations. It is aimed at trustees, management committee members and paid workers who are helping committees to understand their role. The guide can be downloaded free form the Governance Hub website.

Sharing personal information

The Information Commissioner has produced, 'Sharing Personal Information - Our approach' to explain the general approach to information sharing. The guide covers issues including choice, consent, transparency, security and public law. It should help public bodies, in particular, to understand the data protection standards that are expected of those involved in information sharing. This guidance is an essential read for the increasing number of voluntary organisations that are engaging with public bodies, particularly in the delivery of public sector contracts.

Full cost recovery report

The National Audit Office has issued its report, Office of the Third Sector - Implementation of Full Cost Recovery. The report considers the implementation of the principal of full cost recovery in public procurement and concludes full cost recovery is not a concept that public funders can implement or roll out in a mechanistic way. It makes a number of recommendations and states that greater clarity and realism by government in its policy, and better articulation of full cost recovery issues by the third Sector, are required.

Whilst the report does not deal specifically with the Welsh dimension and current Assembly policy, it does provide a useful consideration of the main issues surrounding the subject, and is recommended to voluntary organisations that engage in public service delivery. New charity trading guidance

The Charity Commission has published its revised guidance on charities and trading to help charities avoid the potential risks of trading and get the most out of their trading activities, while also complying with their legal and fiscal requirements.

Trustees, trade and tax - how charities may lawfully trade, has been developed in response to the Better Regulation Commission's call for clear guidance on the subject, and with input from HMRC and representatives from key charities. The guidance provides clear answers to the questions most commonly asked by charities and reflects the latest tax and VAT position, as well as setting out a more flexible policy for funding and investing in trading companies.

Failure to file charity accounts

The Charity Commission has given indications that charities which fail to submit annual returns in good time will be taken off the register after 34 months of non compliance. The Regulator is introducing the measures to deal with 17,000 "hard core" charities that are more than a year late in submitting documents.

The new measures will be used from November if a charity has not filed returns to the Regulator for more than a year and 10 months. If it does not respond to repeated attempts to contact it over the next year, it will be taken off the register. OSCR has already started removing charities from the Scottish register.

Charities and terrorism consultation

On the 10 May 07 the Home Office and HM Treasury launched their consultation, Review of Safeguards to Protect the Charitable Sector (England and Wales) from Terrorist Abuse. Responses should be received by 2 August 07 and the full consultation can be found on the Home Office website.

The CC will be making a full response and it has issued an initial press release (PR 13/ 07).

CC decision and complaints procedure consultations

On 11 June the CC issued 2 consultations on its Decision Review and Complaints and Customer Feedback procedures. The aim is for the two complementary processes to be transparent, quicker and easier to use, and fit more closely with the needs of charities.

Responses are required no later than 3 September 2007 and further information, including the consultation documents, can be found on the CC website.

Charities Act 2006 concise guide

The Cabinet Office and Charity Commission have published, Charities Act 2006 - what trustees need to know, a concise guide to the Charities Act 2006. The guide is primarily aimed at those running small charities that may not have the knowledge or expertise to make the most of the new laws. It explains the main provisions of the Act, and where you can go for further information or guidance on specific provisions. The web-version of the guide will be updated as various provisions of the Act are commenced, or new guidance published.

VAT reduced rates for mobility aids

The Value Added Tax (Reduced Rate) Order 2007 (SI 2007 No 1601), which comes into force on 1 July 2007, amends Schedule 7A to the Value Added Tax Act 1994. Article 3 of the Order adds a new Group 10 (mobility aids for the elderly) to the Index in Part 1 of Schedule 7A (it also adds a new Group 11 - smoking cessation products).

The new Group 10 extends the reduced rate to the installation of mobility aids in private dwellings, together with the supplies of the mobility aids themselves. To qualify, the supplies must be for use by a person aged 60 or over in domestic accommodation.

VAT and subletting

In HMRC v Ardenglen Developments Ltd the company constructed and leased a building to its parent charity which in turn sublet the building to Fair Deal, a separate charity. HMRC argued that VAT zero rating was not available on the first lease (a first grant of a major interest in a building) because by subletting the building the parent charity was not using it for its charitable purposes, but for business purposes. The tribunal found that the lease to Fair Deal was at less than a commercial rate and that the subletting was consistent with the parent charity’s aims and objectives, and thus the building was used for charitable purposes. The lease was at the zero rate, and so the constructing company could still recover VAT on the construction costs of the building.

Registered Social Landlords with similar structures should now review the VAT treatment of their arrangements in the light of this decision, and where appropriate seek HMRC agreement to retrospective zero rating. A fuller summary can be found on the Deloitte website.

WCVA public benefit consultation response

WCVA has submitted its response to the CC consultation on its draft Public Benefit guidance, previously referenced in the March 07 edition of Trustee news. The response, together with all WCVA’s other recent consultation responses, can be found in the Policy section of our website.

WCVA criminal records checks consultation response

On 14 February 2007 the Charity Commission launched, Criminal Records Bureau checks of trustees of charities, a consultation on its approach to Criminal Records checks for trustees of charities working with children or vulnerable adults.

The WCVA Criminal Records Unit has submitted its response to the consultation. The CRU is a Criminal Records Bureau Umbrella Registered Body providing access to the CRB Disclosure service for the voluntary sector within Wales.

WCVA Policy Event Extra

WCVA will be running Policy Event Extra immediately after each of its July regional policy events, starting at 3.00pm and running until 4.30pm. The subject of this consultation will be ‘Unclaimed assets - have your say’. These events are free subject to space - simply return the Booking form. The session has been developed in response to the treasury consultation, Unclaimed Assets distribution mechanism: a consultation.

Reasonable adjustments

The Disability Discrimination Act 1995 states that employers must make reasonable adjustments to prevent disabled people from being put at a substantial disadvantage in comparison with people who are not disabled.

In Spence v Intype Libra Ltd, the Employment Appeal Tribunal held that an employer's failure to make an assessment of a disabled employee before dismissing someone does not amount to a failure to make a reasonable adjustment. Leave was given to appeal to the Court of Appeal.

Maternity leave

The law requires that women who return from maternity leave are normally entitled to return to "the job in which she was employed before her absence". In Blundell v St Andrew's Catholic Primary School the Claimant was a teacher at a primary school, in which the teachers typically rotated classes every two years. When she commenced maternity leave, she was teaching the reception class. On her return, she was allocated to teach Year 2. She alleged that this was not a return to the same job.

The EAT, upholding the tribunal, held that this was the same job. It was necessary to consider three factors when comparing the 'old' and 'new' jobs: nature, capacity and place (see discussion at paras. 51-54). The Claimant was employed as a primary school teacher, and she returned to work as a primary school teacher, therefore the statutory requirement was satisfied.

Campaigning

The Advisory Group on Campaigning and the Voluntary Sector, chaired by Baroness Helena Kennedy QC, reported on 23 May 2007. The Report calls for a "clear and unequivocal" framework to support and enable campaigning by charities, an end to the restricted access of not-for-profit organisations to broadcast media and the removal of the unintended consequences of recent criminal legislation that threaten to restrict "legitimate protest". The Group recommends that trustees should be "free to decide to engage exclusively in political campaigning in furtherance of their charitable purposes" and that "a charity should not have limits placed on the resources that can be committed to political campaigning activities".

Ethical investment

The Charities Aid Foundation has published a free ethical investment guide, Invest today for a better tomorrow, which takes charities through the whole process of ethical investment - from stock selection to risk and reward. The guide can be requested from the CAF website.

Setting up a Network for Chairs, is a new publication from the Governance Hub which gives seven key steps to establishing a network, and guidance on how to make it successful.

Arweiniad newydd ar fasnachu elusennol

Mae’r Comisiwn Elusennau wedi cyhoeddi’i arweiniad diwygiedig ar elusennau a masnachu, i gynorthwyo elusennau i osgoi’r peryglon posibl wrth fasnachu, ac i fanteisio i’r eithaf ar eu gweithgarwch masnachu, gan gydymffurfio hefyd â'u gofynion cyfreithiol ac ariannol.

Datblygwyd Ymddiriedolwyr, masnachu a threth - sut gall elusennau fasnachu'n gyfreithiol, mewn ymateb i alwad y Comisiwn Gwell Rheoliadau am arweiniad clir ar y pwnc, gyda chyfraniad gan Gyllid a Thollau EM a chan gynrychiolwyr o elusennau allweddol. Mae’r arweiniad yn darparu atebion clir i’r cwestiynau mwyaf cyffredin gan elusennau, ac mae'n adlewyrchu sefyllfa ddiweddaraf treth a TAW, ac yn amlinellu polisi mwy hyblyg i ariannu a buddsoddi mewn cwmnïau masnachu.

Methu â ffeilio cyfrifon elusen

Mae’r Comisiwn Elusennol wedi nodi y caiff elusennau a fydd yn methu â chyflwyno datganiadau blynyddol mewn da bryd, eu tynnu oddi ar y gofrestr ar ôl iddynt beidio â chydymffurfio am 34 mis. Mae'r Rheolydd yn cyflwyno'r mesurau er mwyn delio ag 17,000 o elusennau sy'n cyflwyno dogfennau dros flwyddyn yn hwyr.

Bydd y mesurau newydd ar waith o fis Tachwedd ymlaen, a chânt eu gweithredu pan na fydd elusen wedi anfon datganiadau blynyddol i’r Rheolydd ers dros flwyddyn a 10 mis. Oni fydd yr elusen yn ymateb i’r ymdrechion niferus i gysylltu â hi yn ystod y flwyddyn ganlynol, caiff ei thynnu oddi ar y gofrestr. Mae Swyddfa Rheoleiddio Elusennau'r Alban eisoes wedi dechrau tynnu elusennau oddi ar gofrestr yr Alban.

Elusennau ac ymgynghoriad ar derfysgaeth

Ar 10 Mai 07, lansiodd y Swyddfa Gartref a Thrysorlys EM eu hymgynghoriad, Adolygiad o Fesurau Diogelwch i Amddiffyn y Sector Elusennol (Cymru a Lloegr) rhag Camdriniaeth gan Derfysgwyr. Dylai ymatebion gael eu derbyn erbyn 2 Awst 07 a gellir dod o hyd i’r ymgynghoriad cyfan ar wefan y Swyddfa Gartref.

Bydd y CE yn rhoi ymateb llawn ac y mae wedi cyhoeddi datganiad cychwynnol i'r Wasg (PR 13/ 07).

Penderfyniad y CE ac ymgynghoriadau ar y drefn gwyno

Ar 11 Mehefin, cyhoeddodd y CE 2 ymgynghoriad ar ei weithdrefnau Adolygu Penderfyniad a Cwynion ac Adborth Cwsmeriaid. Y nod yw y bydd y ddwy broses ategol hyn yn dryloyw, yn gyflymach ac yn haws eu defnyddio, ac y byddant yn cyd-fynd yn well ag anghenion elusennau.

Arweiniad cryno ar Ddeddf Elusennau 2006

Mae Swyddfa'r Cabinet a’r Comisiwn Elusennau wedi cyhoeddi, Charities Act 2006 - what trustees need to know, sy’n arweiniad cryno i Ddeddf Elusennau 2006. Anelir yr arweiniad yn bennaf at y rheini sy’n rhedeg elusennau bach, nad oes ganddynt efallai'r wybodaeth na’r arbenigedd i wneud yn fawr o’r cyfreithiau newydd. Mae'n egluro prif ddarpariaethau’r Ddeddf, a ble y gallwch fynd i gael gwybodaeth neu arweiniad pellach ar ddarpariaethau penodol. Caiff fersiwn yr arweiniad ar y we ei diweddaru wrth i amrywiol ddarpariaethau’r Ddeddf gael eu rhoi ar waith, neu pan gyhoeddir arweiniad newydd.

Cyfraddau TAW gostyngol ar gyfer cymhorthion symud

Mae Gorchymyn Treth ar Werth 2007 (Cyfradd Gostyngol) (SI 2007 Rhif 1601), a ddaw i rym ar 1 Gorffennaf 2007, yn diwygio Atodlen 7A Deddf Treth ar Werth 1994. Mae Erthygl 3 y Gorchymyn yn ychwanegu Grwp 10 newydd (cymhorthion symud i'r henoed) at y Mynegai yn Rhan 1 Atodlen 7A (mae hefyd yn ychwanegu Grwp 11 newydd - cynhyrchion rhoi'r gorau i ysmygu).

Mae'r Grwp 10 newydd yn ehangu’r gyfradd ostyngol i osod cymhorthion symud mewn anheddau preifat, ynghyd â chyflenwadau’r cymhorthion symud eu hunain. I fod yn gymwys am gyfradd ostyngol, rhaid i'r cyflenwadau fod ar gyfer unigolyn 60 oed neu hyn, sy'n byw yn ei gartref ei hun.

TAW ac isosod

Yn achos Cyllid a Thollau EM v Ardenglen Developments Ltd, fe wnaeth y cwmni adeiladu ac isosod adeilad i’w brif elusen, a wnaeth yn ei dro isosod yr adeilad i Bargen Deg, elusen arall. Dadleuodd Cyllid a Thollau EM nad oedd posibl cael cyfradd sero TAW ar gyfer y brydles gyntaf (y grant cyntaf lle cafwyd buddsoddiad mawr mewn adeilad) gan nad oedd y brif elusen wrth isosod yr adeilad, yn ei ddefnyddio at ddibenion elusennol, ond at ddibenion busnes. Canfu'r tribiwnlys fod y brydles i’r Fargen Deg yn is na chyfradd fasnachol, a bod yr isosod yn gydnaws â nodau ac amcanion y brif elusen, ac felly, câi’r adeilad ei ddefnyddio at ddibenion elusennol. Roedd y brydles ar gyfradd sero, ac felly roedd hi dal yn bosibl i’r cwmni adeiladu adennill y TAW ar gostau adeiladu’r adeilad.

Dylai Landlordiaid Cymdeithasol Cofrestredig sydd â strwythurau tebyg edrych ar y ffordd y delir â’u trefniadau o ran TAW yng ngoleuni’r penderfyniad hwn, a lle bo’n briodol, ceisio dod i gytundeb gyda Chyllid a Thollau EM i gael cyfradd sero ar yr hyn a dalwyd yn flaenorol.

Ymateb WCVA i’r ymgynghoriad ar les y cyhoedd

Ymateb WCVA i’r ymgynghoriad ar archwiliadau cofnodion troseddol

Ar 14 Chwefror 2007, lansiodd y Comisiwn Elusennau Archwiliadau Cofnodion Troseddol ar ymddiriedolwyr elusennau, sef ymgynghoriad ar ei agwedd tuag at archwiliadau Cofnodion Troseddol ar ymddiriedolwyr elusennau sy’n gweithio gyda phlant neu oedolion agored i niwed.

Mae Uned Cofnodion Troseddol WCVA wedi cyflwyno ei ymateb i’r ymgynghoriad. Mae’r Uned Cofnodion Troseddol, yn gorff ymbarél cofrestredig i'r Swyddfa Cofnodion Troseddol, sy’n darparu llwybr at wasanaeth datgelu'r SCT ar gyfer y sector gwirfoddol yng Nghymru.

Addasiadau rhesymol

Yn ôl Deddf Gwahaniaethu ar sail Anabledd 1995, rhaid i gyflogwyr wneud addasiadau rhesymol er mwyn atal pobl anabl rhag bod dan anfantais sylweddol o gymharu â phobl nad ydynt yn anabl.

Yn achos Spence v Intype Libra Ltd, barnodd y Tribiwnlys Apeliadau Cyflogaeth na chai methiant cyflogwr i asesu cyflogwr anabl cyn ei ddiswyddo ei ystyried fel methiant i wneud addasiad rhesymol. Rhoddwyd caniatâd i apelio i'r Llys Apêl.

Absenoldeb mamolaeth

Dan y gyfraith, fel rheol mae gan ferched sy'n dychwelyd wedi absenoldeb mamolaeth hawl dychwelyd i’r "swydd a oedd ganddi cyn ei habsenoldeb" . Yn achos Blundell v Ysgol Gynradd Gatholig St Andrew’s, roedd yr Hawlydd yn athrawes mewn ysgol gynradd lle'r oedd yr athrawon yn tueddu i newid dosbarthiadau bob dwy flynedd. Pan gychwynnodd ar ei habsenoldeb mamolaeth, roedd hi'n dysgu’r dosbarth derbyn. Pan ddychwelodd, gofynnwyd iddi ddysgu Blwyddyn 2. Honnai nad oedd hi’n dychwelyd i’r un swydd.

Barnodd y Tribiwnlys Apeliadau Cyflogaeth, a oedd yn cynnal y tribiwnlys, mai'r un swydd oedd hon. Roedd rhaid ystyried tri ffactor wrth gymharu'r ‘hen’ swydd, a’r swydd ‘newydd’: natur, gallu a lleoliad (gweler y drafodaeth ym mharagraff 51-54). Câi’r Hawlydd ei chyflogi fel athrawes ysgol gynradd, a dychwelodd i’r gwaith fel athrawes ysgol gynradd, felly bodlonwyd y gofyniad statudol.

Ar 23 Mai 2007, cyflwynwyd adroddiad gan y Grwp Ymgynghorol ar Ymgyrchu a’r Sector Gwirfoddol, a gaiff ei gadeirio gan y Farwnes Helena Kennedy CF. Mae’r Adroddiad yn galw am fframwaith pendant a diamwys, i gefnogi a galluogi elusennau i ymgyrchu, am ddiwedd i’r cyfyngiad ar Fudiadau dielw i gael gafael ar gyfryngau darlledu, ac am ddileu canlyniadau anfwriadol deddfwriaeth droseddu ddiweddar, sy’n bygwth gosod cyfyngiadau ar "brotestiadau cyfreithiol". Mae’r Grwp yn argymell y dylai ymddiriedolwyr fod yn "rhydd i benderfynu ymgymryd yn uniongyrchol ag ymgyrchoedd gwleidyddol wrth hyrwyddo eu dibenion elusennol" ac "na ddylai elusen osod cyfyngiadau ar yr adnoddau y gellir eu hymrwymo i weithgareddau ymgyrchu gwleidyddol".

Buddsoddi moesol

Mae’r Sefydliad Cymorth Elusennol wedi cyhoeddi canllaw buddsoddi moesol rhad ac am ddim, Invest today for a better tomorrow, sy’n mynd ag elusennau drwy’r broses gyfan o fuddsoddi moesol - o ddewis stoc i risgiau a buddion. Gellir archebu’r canllaw ar wefan CAF.

Rhwydweithio

Mae Setting up a Network for Chairs yn gyhoeddiad newydd gan Ganolfan y Llywodraeth, sy’n nodi saith cam allweddol i sefydlu rhwydwaith, ac arweiniad ar sut i wneud y rhwydwaith yn llwyddiant.

Gwasanaeth recriwtio ymddiriedolwyr di-dâl

Os ydych chi’n awyddus i recriwtio aelodau di-dâl neu ymddiriedolwyr di-dâl i’ch bwrdd, gallwch hysbysebu am ddim (os oes lle) gyda goodmoves, y gwasanaeth recriwtio amlgyfrwng ar gyfer y trydydd sector.

Menter ar y cyd rhwng WCVA a Big Issue Cymru yw goodmoves. Caiff yr holl swyddi a gaiff eu hysbysebu eu harddangos yn Big Issue Cymru, Big Issue De Orllewin Lloegr, ar wefan goodmoves ac yn Rhwydwaith Swyddi - atodiad wythnosol a ddosberthir i aelodau WCVA. Mae gwasanaeth goodmoves yn cyrraedd dros 100,000 o bobl bob wythnos, a chaiff ei ddosbarthu’n uniongyrchol i dros 1,500 o fudiadau adnabyddus yng Nghymru.
